Version of 1 November 2026
Terms and conditions of sale
Le Plateau du Berger – MAJIL SRL
In the event of any discrepancy, the French version shall prevail.
Article 1 — Identity of the seller
The website www.plateauduberger.be is operated by:
MAJIL SRL, trading as Le Plateau du Berger
Registered office and place of business: Chaussée de Waterloo 589, 1050 Ixelles, Belgium
Company and VAT number: BE 0681.491.019
Telephone: 02 345 34 30
Email: info@plateauduberger.be
Hereinafter referred to as “Le Plateau du Berger” or “the Seller”. MAJIL SRL also operates the cheese shop La Petite Vache Uccle (Avenue Montjoie 23, 1180 Uccle), from which delivered orders are dispatched.
Article 2 — Scope
These general terms and conditions govern sales of products to consumers through the Le Plateau du Berger website.
They apply in particular to orders for cheese platters, raclettes, charcuterie, accompaniments, drinks and other food products offered on the website.
Orders placed by business customers are not governed by these terms and conditions. Business customers are invited to use the platform reserved for them: www.atelierdesfromagers.be.
The customer acknowledges having read and accepted these general terms and conditions before confirming their order.
Article 3 — Products
The main characteristics, composition and price of the products are shown on the website at the time of ordering.
Photographs and illustrations are provided for information only. The presentation, cut, weight, decoration or visual composition of artisan products may vary slightly without affecting their main characteristics.
As some products are cut, assembled or prepared by hand, their actual weight may vary reasonably from the stated weight.
Offers are valid while stocks and available preparation capacity last.
Article 4 — Composition, substitutions and availability
The products offered depend on the season, their degree of ripening and supplies from producers.
If a cheese or another component is unavailable, Le Plateau du Berger may replace it with a product of at least equivalent characteristics, quality and value, provided that the substitution does not substantially alter the nature of the order and does not introduce an allergen that had not been indicated.
Where a substitution substantially alters the order, Le Plateau du Berger will contact the customer to offer:
- a replacement product;
- a change to the order;
- or a refund for the unavailable product.
If the customer cannot be reached in the time needed for preparation, Le Plateau du Berger may make a reasonably equivalent substitution, unless the customer gave instructions to the contrary when ordering.
Article 5 — Allergens and dietary requirements
The products sold may contain, among other things, milk, tree nuts, gluten, eggs, soya, mustard, celery, sulphites or other substances that may cause allergies or intolerances.
Customers with an allergy or intolerance must report it before confirming their order and, if in doubt, contact the cheese shop at info@plateauduberger.be or on 02 345 34 30.
Despite the precautions taken, products are prepared and handled in an environment where several allergens are present. The complete absence of traces or cross-contamination therefore cannot be guaranteed.
This provision does not limit the Seller’s statutory liability with regard to food safety and consumer information.
Article 6 — Ordering process
The customer chooses collection from Le Plateau du Berger or delivery, selects the desired products, provides the information requested (and their address for delivery) and chooses the date and time slot for collection or delivery from the options available.
Before final confirmation, the customer can check the details of their order, the total price and any delivery charges, and correct any errors.
The order becomes final after:
- acceptance of these general terms and conditions;
- clicking the button that clearly indicates an obligation to pay;
- confirmation of payment, for orders paid online;
- and an order confirmation has been sent by email.
The Seller may refuse or cancel an order in the event of unavailability, an obvious pricing error, a payment problem, suspected fraud or the practical impossibility of preparing the order. In that case, any sums already received will be refunded without undue delay.
Article 7 — Prices
Prices are stated in euros, inclusive of all taxes.
The applicable price is the one displayed when the order is confirmed. Before payment, the customer receives a summary showing the total price payable.
Delivery charges and any returnable deposits, security deposits or additional options are shown separately before the order is confirmed.
Article 8 — Payment
For an online order, full payment is made at the time of ordering.
The payment methods offered may include:
- Bancontact;
- accepted payment cards;
- other methods offered through the Mollie payment platform.
Where the option to pay on site is expressly offered during the ordering process, full payment must be made on collection, using one of the payment methods accepted in the shop at that time.
Le Plateau du Berger does not store the customer’s full bank details. Electronic payments are processed by the payment service providers involved in the transaction.
Article 9 — Collection from the shop and delivery
9.1 Collection
Orders for collection are collected from the following address: Le Plateau du Berger, Chaussée de Waterloo 589, 1050 Ixelles.
Collection must take place on the date and within the time slot chosen and confirmed. The customer must show their order confirmation or provide the details needed to identify it.
The order is kept chilled in appropriate conditions until the shop closes on the day scheduled for collection.
If running late, the customer is asked to let the shop know as soon as possible on 02 345 34 30. Le Plateau du Berger will do its best to keep the order until the customer arrives, but cannot guarantee that it can be handed over after closing time.
Unless expressly agreed by the cheese shop, any order not collected before closing time on the agreed day will be deemed abandoned. Given the fresh, perishable and specially prepared nature of the products, it cannot be kept for later collection or refunded.
This rule does not apply where the failure to collect is due to the Seller’s fault or where the customer demonstrates force majeure. In the latter case, the parties will seek a reasonable solution, taking into account the condition of the products and whether they can be reused.
9.2 Delivery in Brussels
Delivered orders are prepared by the cheese shop La Petite Vache Uccle (MAJIL SRL, Avenue Montjoie 23, 1180 Uccle) and transported by a partner courier, within the areas offered when ordering (in principle, the 19 municipalities of the Brussels-Capital Region). Charges, any minimum order amount and available time slots are displayed according to the customer’s address before payment.
The customer must ensure that someone is present at the address given throughout the chosen time slot and must provide any useful information (floor, access code, contactable telephone number). If nobody is able to receive the order despite the courier’s reasonable attempts, it will be taken back to the Uccle cheese shop, where the customer may collect it the same day; a new delivery may be arranged at the customer’s expense if the condition of the products allows.
Article 10 — Changes or cancellation by the customer
The customer may request a change to or cancellation of their order up to eight hours before the preparation time stated in the order confirmation.
Requests must be made:
- by email to info@plateauduberger.be;
- or by telephone on 02 345 34 30.
A request only takes effect once Le Plateau du Berger has confirmed that it has been processed.
Where a cancellation is validly made within this period, the sums paid will be refunded using the original payment method, unless the customer agrees otherwise.
After this period, the order can in principle no longer be changed, cancelled or refunded, as purchasing, cutting and preparation may already have begun. Le Plateau du Berger may nevertheless accept a change or cancellation as a goodwill gesture where the stage of preparation allows.
Article 11 — No right of withdrawal
The cheese platters, raclettes and other fresh food products sold by Le Plateau du Berger are liable to deteriorate or expire rapidly. Some products are also made or assembled according to the customer’s specifications.
Consequently, in accordance with the statutory exceptions applicable to distance contracts, these products are not subject to the fourteen-day right of withdrawal.
The absence of a right of withdrawal does not affect the customer’s rights in the event of a product that is defective, does not conform to the order or is unfit for consumption.
This exception for fresh food is recognised by the FPS Economy.
Article 12 — Storage and consumption
The customer must transport the products in suitable conditions, refrigerate them as soon as possible and follow the storage and consumption instructions provided on collection or delivery.
Unless otherwise stated, fresh products must be kept at the temperature recommended on their packaging or advised by the cheese shop.
Once the order has been handed over to the customer, Le Plateau du Berger cannot be held liable for any deterioration caused by a break in the cold chain, inappropriate storage, late consumption or failure to follow the instructions provided.
This provision does not affect the Seller’s liability for a defect existing at the time the product is handed over.
Article 13 — Equipment loan
Raclette machines may be lent, subject to availability and the conditions stated when ordering:
- the household machine is lent free of charge and without a deposit for raclette orders for six people or more, to be collected with the order or delivered with it;
- the traditional half-wheel machine accompanies a half-wheel raclette; it is available for collection from the shop only, against a deposit of 50 euros paid on site.
The equipment must be returned to the shop where it was collected, or to the Uccle cheese shop for a delivered machine, within 48 working hours. The deposit is refunded once the equipment has been returned, provided that it is:
- complete;
- reasonably clean;
- and free from damage other than normal wear and tear.
In the event of loss, incomplete return or damage attributable to the customer, Le Plateau du Berger may deduct the actual and justified cost of repair or replacement from the deposit. If this cost is lower than the deposit, the balance is refunded to the customer. If the cost is higher, or for a machine lent without a deposit, the Seller may claim the corresponding amount upon presentation of supporting evidence.
Article 14 — Alcoholic drinks
The sale of alcoholic drinks is restricted to persons who meet the age requirements laid down by Belgian law.
Customers ordering an alcoholic drink declare that they are of the required legal age. Proof of age may be requested on collection or delivery. If sufficient proof is not provided, the drink may be withheld in accordance with the law.
Article 15 — Conformity and complaints
The customer must check their order on collection or delivery insofar as such a check is reasonably possible.
Any error, missing product or visible defect should preferably be reported immediately. A problem discovered later must be reported as soon as possible, if possible with the order number, a description and photographs.
Complaints may be sent to: info@plateauduberger.be – MAJIL SRL, Le Plateau du Berger, Chaussée de Waterloo 589, 1050 Ixelles.
Recommending prompt reporting does not reduce or remove the consumer’s statutory rights.
Article 16 — Liability
Le Plateau du Berger is responsible for the proper performance of the order in accordance with applicable law.
It cannot be held liable for any delay or failure to perform resulting from force majeure or from an unforeseeable circumstance beyond its control, such as a major breakdown, an interruption in supplies, a disaster, a decision by the authorities or an event making preparation impossible.
In such a case, the customer will be informed as soon as reasonably possible. Where the order definitively cannot be fulfilled, the sums corresponding to the products not supplied will be refunded.
Nothing in these terms and conditions limits the consumer’s mandatory rights or any liability that cannot legally be excluded.
Article 17 — Personal data
The personal data collected are used to process orders, payments, collections and deliveries, to communicate with the customer and to comply with administrative and legal obligations.
Details of how the data are processed, retention periods and the rights of data subjects are set out in the privacy policy.
Article 18 — Evidence and electronic communications
Order confirmations, emails and data recorded by the ordering system may serve as evidence of communications and transactions, subject to the customer’s right to dispute their accuracy.
The customer must provide a correct email address and, where necessary, check their spam folder.
Article 19 — Governing law and dispute resolution
These terms and conditions are governed by Belgian law, without depriving the consumer of the mandatory protections they enjoy.
In the event of a problem, the customer is invited to contact Le Plateau du Berger first in order to seek an amicable solution.
Failing agreement, the consumer may contact the Consumer Mediation Service or use the out-of-court dispute resolution mechanisms made available by the Belgian authorities.
Any dispute that cannot be resolved amicably falls within the jurisdiction of the competent courts in accordance with the applicable legal rules. These terms and conditions do not impose the exclusive jurisdiction of any particular court on the consumer.
Article 20 — Final provisions
If any provision of these terms and conditions is declared void or unenforceable, the remaining provisions shall continue to apply to the extent permitted by law.
Failure by Le Plateau du Berger to exercise a right immediately does not constitute a waiver of that right.
The applicable version is the one accepted by the customer at the time of ordering. Any subsequent changes do not apply to orders already confirmed.
